Scope of this notice: our role as controller, not processor. It does not describe how we handle images or other content that a business customer submits to VIESUS Cloud for enhancement ("Customer Content"). When we process Customer Content on behalf of a business customer, we act as a processor (or sub-processor), and that processing is governed by our Terms of Service and, where applicable, a separate data processing agreement, not primarily by this notice. Business Use Only. VIESUS Cloud is provided for business-to-business ("B2B") use only, consistent with our Terms of Service. The individuals whose personal information we process under this notice are typically our own website visitors, prospects, and the account holders, administrators, or other personnel of our business customers — not consumers using VIESUS Cloud for personal, family, or household purposes.

We collect names; phone numbers; email addresses; mailing addresses; job titles; company names; usernames; passwords; API keys and access credentials; contact preferences; contact or authentication data; billing addresses; debit/credit card or other payment information; and other similar information.

In Short: VIESUS Cloud does not currently offer registration or login using third-party social media accounts.
At this time, you cannot register for or log in to VIESUS Cloud, or any other part of the Website, using a third-party social media account (such as Google, Facebook, or similar services). Account registration and authentication is handled directly through the credentials and API keys described in Section 1.
If we introduce social media login in the future, we will update this notice before doing so to describe what profile information we would receive from the relevant provider, how we would use it, and how you can manage that connection.
In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this privacy notice unless otherwise required by law.
We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). No purpose in this notice will require us keeping your personal information for longer than six (6) months past the termination of your account, consistent with the inactive-account deletion described in our Terms of Service.
This retention period applies to account and contact information handled under this notice. If your VIESUS Cloud account is inactive for six (6) consecutive months, we will deactivate and permanently delete the account together with any associated data, as described in Section 3(d) of our Terms of Service. Customer Content and Output submitted to VIESUS Cloud for image enhancement are deleted on a shorter timeline — no later than thirty (30) days after processing, or sooner if configured — as described in Section 3(c) of our Terms of Service. You may also request deletion of your account and associated data at any time before then; see What Are Your Privacy Rights? below.
When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security, and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Website is at your own risk. Where required by applicable law, we will notify affected individuals and/or the competent supervisory authority of a personal data breach within the timeframe required by that law.
The infrastructure supporting the Website and VIESUS Cloud is currently hosted in the Netherlands and the United States. If you access the Website or VIESUS Cloud from a region with data protection laws that differ from those of the Netherlands or the United States, your information may be transferred to, stored, and processed in those countries.
Where such transfers involve personal information protected under the Swiss Federal Act on Data Protection (FADP) or the EU General Data Protection Regulation (GDPR), we rely on legally recognized transfer mechanisms, such as standard contractual clauses or an adequacy decision, as applicable and as such mechanisms may be updated by the competent authorities from time to time. Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.

California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are under 18 years of age, reside in California, and have a registered account with the Website, you have the right to request removal of unwanted data that you publicly post on the Website. VIESUS AG has not disclosed or sold any personal information to third parties for a business or commercial purpose in the preceding 12 months, and will not sell personal information belonging to website visitors, users, or other consumers.
Your rights with respect to your personal data
Right to request deletion of the data — Request to delete. You can ask for the deletion of your personal information. If you ask us to delete your personal information, we will respect your request and delete your personal information, subject to certain exceptions provided by law, such as our compliance requirements resulting from a legal obligation or any processing that may be required to protect against illegal activities.
Right to be informed — Request to know. Depending on the circumstances, you have a right to know: whether we collect and use your personal information; the categories of personal information that we collect; the purposes for which the collected personal information is used; whether we sell your personal information to third parties; the categories of personal information that we sold or disclosed for a business purpose; the categories of third parties to whom the personal information was sold or disclosed for a business purpose; and the business or commercial purpose for collecting or selling personal information.
In accordance with applicable law, we are not obligated to provide or delete consumer information that is de-identified in response to a consumer request or to re-identify individual data to verify a consumer request.

Verification process
Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with information you have previously provided us, or we may contact you through a communication method (e.g. phone or email) that you have previously provided to us. We will only use personal information provided in your request to verify your identity or authority to make the request, and we will delete any additionally provided verification information as soon as we finish verifying you.

We do not use your personal information to make decisions producing legal effects concerning you, or similarly significant effects, based solely on automated processing, without human involvement. VIESUS Cloud's image enhancement functionality applies automated processing to Customer Content submitted by our business customers, but this processing enhances images according to customer-specified instructions and does not involve automated decision-making about individuals. If this changes in the future, we will update this notice to describe the logic involved and your related rights.
